What's happening
This bill requires New York to reimburse medical facilities for providing medically necessary donor breast milk to critically ill infants under three months in neonatal intensive care.
Why it matters
Improves access to lifesaving nutrition for vulnerable infants. By ensuring reimbursement for medically necessary donor breast milk, the bill supports critically ill infants who cannot receive enough milk from their own mothers, potentially reducing complications and improving survival rates in neonatal intensive care units (NICUs).
Establishes strict medical and safety standards. The bill requires that donor milk must be prescribed by a licensed physician, be deemed medically necessary, and come from milk banks meeting state quality requirements. This helps ensure both the necessity and safety of the milk provided.
Mandates informed consent and transparency. Parents or legal guardians must sign a consent form detailing the risks and benefits of using banked donor milk, promoting transparency and empowering families to make informed decisions about their child’s care.
Aligns with national best practices and federal law. The use of an evidence-based prior authorization system and adherence to national standards aims to streamline the process and ensure only appropriate cases are approved, while requiring the state to seek any needed federal approvals for implementation.
