What's happening

This bill requires anyone subject to an order of protection to wear an electronic monitoring device and makes tampering a felony.

Why it matters

  1. Expands state surveillance and monitoring. by mandating that anyone subject to an order of protection must wear an electronic device, significantly increasing law enforcement’s ability to track individuals in real time.

  2. Raises the stakes for compliance. by making any tampering with the monitoring device a felony offense, which could mean prison time for actions that might previously have been handled as a violation or contempt of court.

  3. Impacts due process and privacy rights. for those subject to orders of protection, potentially affecting individuals who have not been convicted of a crime but are under a court order, thus broadening the use of electronic monitoring beyond convicted offenders.

  4. Could serve as a deterrent or provide assurance to protected parties. (often domestic violence victims), but also might raise concerns about the technology’s reliability, costs, and the broader social implications of mandated electronic surveillance.
