What's happening

This bill expands the definition of "immediate family" for re-issuing environmental licenses or permits after a holder's death.

Why it matters

  1. Expands who qualifies as "immediate family". for the purposes of inheriting environmental licenses or permits, now including anyone related by blood, marriage, or adoption to the deceased holder, not just those living in the same household.

  2. Facilitates smoother transfer of licenses/permits after a holder's death. , potentially reducing disruptions for family-run businesses or generational operations that rely on these environmental permissions.

  3. Applies retroactively to deaths since 2013. , offering families who lost a license/permit holder in recent years new opportunities to have those licenses or permits re-issued to a broader group of relatives.

  4. Reduces the risk of licenses being lost due to technicalities about household residency. , making it easier for families with members living apart (e.g., adult children or siblings not living together) to keep critical environmental permissions within the family.
