What's happening
This bill makes it a felony to purchase or sell more than 3.6 grams per day or 9 grams per month of pseudoephedrine.
Why it matters
Targets Methamphetamine Production. By criminalizing purchases or sales of pseudoephedrine above set daily/monthly limits, the bill aims to reduce the diversion of this common cold medicine for illegal meth production, directly addressing a key supply chain step in methamphetamine manufacturing.
Felony Charges and Deterrence. Making violations a class E felony (rather than a lesser offense) significantly raises the legal stakes, which could deter both individuals and organized groups from stockpiling pseudoephedrine for illicit use.
Applies to Both Buyers and Sellers. The law does not distinguish between purchasers and sellers, meaning both pharmacy customers and retailers face felony charges for exceeding the limits, potentially changing how pseudoephedrine is sold and tracked.
Potential for Tighter Retail Controls. Retailers may need to implement stricter sales monitoring, recordkeeping, and staff training to avoid legal exposure, which could affect consumer convenience and pharmacy operations.
