What's happening

This bill requires certain agencies to have staff on-call 24/7 to respond to notices about medical orders for life-sustaining treatment for developmentally disabled persons.

Why it matters

  1. Ensures immediate oversight. By requiring the mental hygiene legal service and the commissioner of developmental disabilities to have staff available 24/7, the bill aims to ensure that any objections or concerns about life-sustaining treatment for developmentally disabled individuals can be addressed without delay, even outside normal business hours.

  2. Promotes timely decision-making. This constant availability is crucial in urgent medical situations where decisions about life-sustaining treatment must be made quickly, reducing the risk of unnecessary suffering or inappropriate medical interventions due to administrative delays.

  3. Strengthens legal protections. The bill reinforces the rights of developmentally disabled individuals by guaranteeing that agencies tasked with protecting these rights are always accessible, potentially reducing the likelihood of unilateral or unchallenged decisions about critical medical care.
