What's happening
The bill exempts the ACT exam from certain education law requirements if ACT, Inc. discloses at least three test forms each year.
Why it matters
Increases flexibility for the ACT exam in New York. By exempting the ACT from certain state education law requirements, the bill could allow ACT, Inc. to operate with fewer regulatory hurdles, potentially making it easier to administer and update the test for New York students.
Ties transparency to exemption. The exemption only applies if ACT, Inc. publicly releases at least three test forms per year. This provision aims to promote test transparency and fairness, so students and educators can review actual test content and better understand the exam.
May impact how students prepare for college admissions. Access to disclosed test forms could give New York students and teachers more resources for targeted preparation, possibly affecting test prep strategies, educational equity, and student performance on the ACT.
Could influence standardized testing policy. This change sets a precedent for balancing regulatory oversight with transparency requirements. Other exam providers or states might look to this model when considering similar exemptions or disclosure mandates.
