What's happening

This bill adds the New York State Power Authority and its employee unions to mandatory arbitration provisions under civil service law.

Why it matters

  1. Expands bargaining power for NY Power Authority employees. By including the New York State Power Authority in mandatory arbitration, its unionized workers gain access to a dispute resolution process previously available to other major public authorities, potentially increasing their leverage in contract negotiations.

  2. Limits potential for labor disruptions. Mandatory arbitration can help resolve deadlocks without strikes or work stoppages, which is especially important given the Power Authority’s role in providing electricity to government buildings, schools, and other critical infrastructure across the state.

  3. Aligns Power Authority labor policy with other transit and utility agencies. The change puts the Power Authority on a similar legal footing with the MTA and NYC Transit Authority, reflecting a broader trend of standardizing labor dispute mechanisms across major public employers in New York State.

If either party fails to designate its member to the public arbitration panel, the board shall promptly, upon receipt of a request by either party, designate a member associated in interest with the public employer or employee organization he is to represent. If, within seven days after the mailing date, the parties are unable to agree upon the one public member, the board shall submit to the parties a list of qualified, disinterested persons for the selection of the public member. Each party shall alternately strike from the list one of the names with the order of striking determined by lot, until the remaining one person shall be designated as public member. § 2. This act shall take effect immediately; provided, however, that the amendments made to paragraph (a) of subdivision 5 of section 209 of the civil service law by section one of this act shall not affect the expiration of such subdivision and shall be deemed to expire therewith.
