What's happening

This bill allows members of New York State and City Teachers' Retirement Systems to claim up to ten years of retirement credit for certain federal teaching service, including Peace Corps, VISTA, or Head Start.

Why it matters

  1. Expands retirement benefits to recognize federal teaching service. By allowing up to ten years of credit for Peace Corps, VISTA, or Head Start service, the bill acknowledges the value of federal teaching roles and incentivizes professionals with diverse teaching backgrounds to remain in or join New York’s education workforce.

  2. Potentially boosts retirement security for educators. Teachers who have federal service experience but previously could not count that time toward state or city retirement now stand to retire earlier or with increased pension benefits, making public teaching careers more attractive.

  3. Includes safeguards to prevent double-dipping. The bill explicitly bars credit for federal service if the individual is already receiving or will receive retirement benefits for that same service from another public or private plan, ensuring the system only pays for unique, uncredited service.

  4. Carries fiscal implications for public employers. The extension of credit could increase costs for school districts and the state/city, estimated at $17,300–$22,200 per credited year (before member offsets), potentially affecting pension funding and future budgets depending on uptake.

FISCAL NOTE.--Pursuant to Legislative Law, Section 50:

This bill would amend section 509 of the Education Law and sections

446, 513, and 609 of the Retirement and Social Security Law to permit

members of the New York State Teachers' Retirement System to claim

service credit for up to ten years of federal teaching service (includ-

ing Vista, Head Start, and the Peace Corps). Payments for such credit

must be made by those members subject to Article 14 of the Retirement

and Social Security Law in accordance with section 517 of such law and

by those members subject to Article 15 of the Retirement and Social

Security Law in accordance with section 613 and paragraph 2 of subdivi-

sion b of section 609 of such law.

It is not possible to determine the total annual cost to the employers

of members of the New York State Teachers' Retirement System since the

total amount of service credit which would be claimed under this bill

cannot be estimated. However, the cost to the employers of members of

the New York State Teachers' Retirement System is estimated to be

$22,200 per year of service credited for Tier 1, 2, 3, 4 and 5 members

and $17,300 per year of service credited for Tier 6 members if this bill

is enacted. These costs would be offset by member payments required in

accordance with section 517 and section 613 and paragraph two of subdi-

vision b of section 609 of the Retirement and Social Security Law.
