What's happening
This bill restricts electric corporations from using eminent domain for certain transmission lines or generating facilities connected to locations outside the United States.
Why it matters
Limits foreign energy influence. By blocking eminent domain for projects linking New York to energy sources or generating facilities outside the U.S., the bill aims to prevent foreign-produced electricity from being routed into New York, unless New York-based generation can also directly benefit from the infrastructure.
Protects local property rights. The bill restricts electric corporations from seizing private property in New York via eminent domain for certain cross-border projects, prioritizing local control over land use and potentially reducing conflicts with landowners.
Supports environmental standards. Projects connecting to generation facilities—whether existing or proposed—must demonstrate compliance with New York’s power plant emissions and performance standards. This helps ensure imported electricity meets state environmental requirements, potentially discouraging reliance on out-of-state (and out-of-country) sources with laxer environmental rules.
