What's happening

This bill requires state-owned parking facilities in New York to install and maintain electric vehicle charging stations, with associated costs covered by the state.

Why it matters

  1. Significantly expands EV infrastructure at state facilities. By mandating that 10% to 20% of parking spaces at state-owned lots and garages be equipped with charging stations, the bill ensures that state employees and the public will have much greater access to reliable EV charging on government property, helping address “range anxiety” and supporting broader EV adoption.

  2. Sets technical and installation standards. The bill specifies minimum electrical capacities, raceway sizes, and code compliance for new and existing facilities, signaling thorough planning for reliable, future-proof EV charging infrastructure and preventing haphazard or underpowered installations.

  3. Guarantees free charging for users. The state will cover all installation, maintenance, and utility costs, and is explicitly prohibited from charging users for electricity. This not only removes a financial barrier for EV owners but could also make state jobs and services more attractive to those considering or already owning electric vehicles.

  4. Establishes clear enforcement and signage. The measure requires dedicated signage and authorizes police and parking enforcement to issue citations for non-EVs occupying charging spots, helping ensure spots are available for those who need them and preventing misuse that could undermine the program’s effectiveness.

Pursuant to subdivisions one and two of this section, parking garages shall be capable of supporting electric vehicle charging stations through an electrical raceway to the electric supply panel serving the garage that shall be capable of providing a minimum of 3.1 kW of electrical capacity to each charging stall connected to it with the raceway. Such raceway and all components and work appurtenant thereto shall be in accordance with state, city and municipal electrical codes.

5. The office of general services shall be responsible for the installation of any electric vehicle supply equipment. 8. State, city and/or municipal policing authorities and/or parking enforcement are hereby authorized to issue citations or take any other appropriate action in the event of a violation of subdivision seven of this section in accordance with existing vehicle and traffic law and parking restrictions imposed by any parking facility in which the electric vehicle supply equipment is located.

9. The state of New York shall assume all costs of installing, operating and maintaining any electric vehicle supply equipment, including the cost of utilities associated with the charging of vehicles. The state of New York is also prohibited from charging an individual, who is authorized by this section, in any way, for the use of such electric vehicle supply equipment offered by a state owned and/or operated parking facility.

§ 2. This act shall take effect immediately.
