What's happening
This bill directs the transfer of certain transportation-related tax revenues to support public transportation and mass transit operating assistance accounts in New York State.
Why it matters
Redirects TNC (e.g., Uber/Lyft) Tax Revenues. The bill specifically channels taxes, fees, interest, and penalties collected from transportation network companies (TNCs) for trips originating outside New York City to dedicated public transportation and mass transit operating assistance accounts, ensuring these funds are used to support regional transit systems rather than going into the general fund.
Creates Accountability and Flexibility. The bill authorizes the State Comptroller, in consultation with other state officials, to decide how and where to allocate these revenues within public transit accounts, and also permits withholding funds from local transit agencies if a city or county reduces its own contributions—effectively discouraging local funding cuts and promoting stable local-state transit partnerships.
Ensures Supplemental—Not Replacement—Funding. The language clarifies that TNC-related revenue supplements existing transit funding formulas and cannot be used to replace or reduce other dedicated transit funding streams. This means that public transportation systems should see a net funding increase, supporting service stability or growth.
Prioritizes Regional Equity. The bill requires that funds generated from TNC trips are distributed in proportion to where the trip originated and, where both bus and commuter rail services exist, split evenly between them. This structure aims to ensure that regions generating the revenue benefit directly, and both bus and commuter rail systems are supported in areas they both serve.
