What's happening

This bill exempts land used to grow bio-energy crops for alternative fuel from property taxes for five years.

Why it matters

  1. Encourages renewable energy production. by making it more financially attractive for landowners to grow bio-energy crops intended for cellulosic ethanol, potentially expanding the state’s supply of alternative fuels.

  2. Supports agricultural diversification and rural economies. by providing a significant tax incentive for farmers and landowners to convert or dedicate land to bio-energy crop production, offering a new potential revenue stream.

  3. Includes accountability measures. requiring proof that land is actually used for eligible bio-energy crops to receive the tax exemption, aiming to prevent misuse of the incentive and ensure it targets genuine alternative fuel efforts.

  4. Time-limited policy allows for evaluation. as the exemption is set to expire after five years, giving policymakers a chance to assess the program’s impact on energy production, farm income, and tax revenues before deciding on extension or modification.

AN ACT to amend the real property tax law, in relation to providing a real property tax exemption on lands used for certain agricultural purposes; and providing for the repeal of such provisions upon expiration thereof

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

Section 1. The real property tax law is amended by adding a new section 481-a to read as follows:

2. Such exemption shall not be granted to a property owner unless such owner provides the taxing authority with proof, satisfactory to the office of real property services, that such lands are used for the purposes described in subdivision one of this section.
