What's happening

This bill creates a tax credit reimbursing farm vehicle owners in the metropolitan commuter district for their vehicle registration fees.

Why it matters

  1. Helps lower farming costs in high-tax regions. By reimbursing registration fees for farm vehicles in the metropolitan commuter district, this bill directly reduces overhead for farmers operating in areas with some of the state’s highest costs, potentially making local agriculture more sustainable.

  2. Provides full, refundable relief. The tax credit is for 100% of the farm vehicle registration fee, and if the credit exceeds a farmer’s state tax liability, the excess is refunded—meaning farmers can get back the entire fee even if they owe little or no state tax.

  3. Targets a specific regional economic pressure. The bill responds to a unique burden faced by farmers in the downstate “metropolitan commuter district,” where special fees apply, potentially leveling the playing field between rural and suburban/urban agriculture.

  4. Could encourage continued agricultural activity near urban centers. By offsetting a fixed and recurring cost, this measure may help retain or attract farm operations in the commuter belt, supporting local food production and rural land use in regions where development pressure is intense.

hundred ninety-nine-a of the vehicle and traffic law for a farm vehicle registered pursuant to subdivision thirteen of section four hundred one of the vehicle and traffic law shall be allowed a credit of one hundred percent of such fee against the tax otherwise imposed by this article.

(b) Application of credit. The credit allowed under this subdivision for any taxable year shall not reduce the tax due for such year to less than the fixed dollar minimum amount prescribed in paragraph (d) of subdivision one of section two hundred ten of this article. However, if the amount of credit allowed under this subdivision for any taxable year reduces the tax to such amount or if the taxpayer otherwise pays tax based on the fixed dollar minimum amount, any amount of credit thus not deductible in such taxable year shall be treated as an overpayment of tax to be credited or refunded in accordance with the provisions of section one thousand eighty-six of this chapter. Provided, however, the provisions of subsection (c) of section one thousand eighty-eight of this chapter notwithstanding, no interest shall be paid thereon.

§ 4. This act shall take effect immediately and shall apply to taxable years beginning on and after January 1, 2016.
