What's happening

This bill allows certain New York public employees to use accrued sick, compensation, or vacation time if injured at work before workers' compensation coverage begins.

Why it matters

  1. Provides immediate financial stability. By allowing public employees to use their accrued sick, comp, or vacation leave if they’re injured on the job but not yet receiving workers’ compensation, the bill helps prevent unpaid gaps that could otherwise create financial hardship.

  2. Closes a coverage loophole. The bill addresses a period where injured employees might have no income because there is often a delay before workers’ compensation benefits begin, ensuring that workers aren’t left unsupported due to bureaucratic processing times.

  3. Protects accrued leave balances. While employees can use their own leave to maintain their income, this also means they may deplete their earned time off if there is a delay in workers’ compensation coverage, potentially impacting future time-off needs.

  4. Standardizes support across public sectors. This amendment applies broadly to state, county, school district, and other public employees, creating a more consistent safety net for public workers across New York.
