What's happening

This bill requires school districts to notify parents when a sex offender resides in their district and provides state reimbursement for related mailing expenses.

Why it matters

  1. Mandates direct parental notification. School districts must now send notifications to parents or guardians of every student when they are informed by law enforcement that a moderate- or high-risk sex offender is residing in the district, ensuring families are made directly aware rather than relying on passive or general public notifications.

  2. Standardizes communication protocols. By requiring school districts to disseminate information received from law enforcement—including photos, names, addresses, and other relevant details—this bill creates consistency in how and when parents are informed, potentially reducing gaps or delays in critical safety information.

  3. Reduces financial burden on schools. The state will reimburse school districts for the mailing costs associated with these notifications, removing the financial disincentive for districts to comply fully and ensuring that cost is not a barrier to informing parents.

  4. May impact community awareness and response. By increasing transparency and timely parental awareness about sex offenders in the area, the bill could lead to heightened community vigilance and possibly changes in student safety practices or parental decisions regarding children’s activities and routes to school.

Sponsor's memo

Title of bill

An act to amend the correction law, in relation to required notification by school districts of sex offender residence; and to amend the education law, in relation to apportionment to school districts for certain expenses related to sex offender notification

Purpose

This bill would require that a school district shall distribute information on sex offenders residing within the school district to the parents of its students.

Summary of provisions

Paragraphs (b) and (c) of subdivision 6 of section 168-1 of the correction law, paragraph (b) as amended by chapter 513 of the laws of 2011 and paragraph (c) as separately amended by chapters 318 and 680 of the laws of 2005, are amended.

Justification

Megan's Law requires level two and level three sex offenders register with local law enforcement agencies, who may distribute information including the offenders name, picture, address, location of employment and background information.

This legislation would require a school district, upon receiving this information from law enforcement officials, to distribute the information to the parents of its students.

The rate of recidivism among sex offenders is very high, as such, it is important that the public is aware of any dangerous offenders who may be living in their neighborhood. The information is currently available to the public, but many parents are not aware of this, or do not know where to look to find the information. Sending the offenders' profiles to the parents in the school district provides an extra assurance that each household has the invaluable information that could protect their children from dangerous predators.

This legislation provides funding to reimburse the school districts for their costs related to complying with this requirement.
