What's happening
This bill requires state-run residential facilities to keep site plans on file and make them available to local officials and emergency responders upon request.
Why it matters
Improves emergency preparedness and response. By ensuring that emergency responders have access to up-to-date site plans, the bill enables faster and more effective responses during fires, medical emergencies, or evacuations at state-run residential facilities.
Increases local oversight and coordination. Local municipal officials will have a clearer understanding of the layout and operations of state-controlled residential facilities in their jurisdiction, enhancing coordination and oversight.
Establishes a uniform standard for all state agencies. The bill applies to any state department, authority, or public benefit corporation, setting a consistent requirement across all types of state-run residential facilities, regardless of agency or location.
Addresses safety and transparency concerns. Making site plans accessible upon request may help address concerns from local communities and families about the safety and transparency of state-operated residential homes, particularly those serving vulnerable populations.

Existing law
New York State has sovereign immunity with respect to local laws.
Justification
On March 21, 2009, a tragic fire broke out at the State's Riverview IRA group home. Four residents lost their lives in the fire. First responders to the fire were impeded by not having site plans to locate and evacuate the residents from the building. This legislation requires every state residential facility to have accessible a facility site plan. The plans must be made available to the local municipal governing body and emergency responders upon request, ensuring the health and safety of those who live and work in residential facilities.
