What's happening
This bill prohibits the siting or licensing of radioactive or hazardous waste facilities within 1,500 feet of school property.
Why it matters
Aims to protect children's health and safety. by ensuring that hazardous and radioactive waste facilities cannot be located near schools, reducing students’ potential exposure to dangerous substances.
Creates clearer siting restrictions for waste facilities. , making it more difficult for companies or agencies to place or operate these types of facilities in densely populated or vulnerable areas, especially where children are present.
Could affect local development and property values. , as it may prevent certain types of industrial or waste-related projects near schools, potentially impacting both community planning and industrial interests.
Reflects growing concerns over environmental justice. , as schools are often located in or near communities that have historically faced higher environmental risks, so this law could contribute to more equitable public health protections.

Title of bill
An act to amend the environmental conservation law, in relation to the siting and licensing of radioactive or hazardous waste disposal or transfer stations
Purpose
To prohibit radioactive hazardous waste disposal or transfer stations from being sited within 1500 feet of school property.
Summary of provisions
The environmental conservation law is amended by adding a new section 27-0111.
Justification
In the past, New York state has been very irresponsible, allowing radioactive waste facilities to be sited next to or too close to places of concern, such as a public elementary school. If some sort of disaster would occur at this hazardous waste facility, something as serious as a fire, because of its proximity to the school, the results could be devastating. Especially, if the nearest fire house was recently closed due to budget cuts. Therefore, it is with responsibility that I introduce this legislation to not allow the siting and licensing of hazardous or radioactive waste disposal or transfer stations to be within 1500 feet of the boundary of any school property. cited
