What's happening
This bill establishes the Nissequogue River State Park by designating and describing specific parcels of land in Suffolk County.
Why it matters
Secures long-term public access and conservation. By designating these specific parcels as a state park, the legislation ensures that the land will be protected from private development, preserving open space and natural resources for community recreation, wildlife habitat, and environmental health.
Transforms former psychiatric center land. The bill repurposes a substantial portion (over 365 acres) of the former Kings Park Psychiatric Center, shifting its use from institutional to public recreational, which can help heal community divisions and honor the legacy of the site.
Specifies legal boundaries and exclusions. The highly detailed metes-and-bounds descriptions, along with specific exceptions (such as land reserved for fire district use and certain parcels near a cemetery), clarify what is and isn’t included, reducing the risk of future legal disputes, confusion, or unintended land transfers.
Potential for increased local investment and tourism. Official state park designation may attract more state funding for park infrastructure and maintenance, enhance local property values, and drive tourism, benefiting the regional economy and providing new amenities for residents.

Title of bill
An act to amend the parks, recreation and historic preservation law, in relation to establishing the Nissequogue River state park
Purpose
To statutorily designate certain state-owned land as the Nissequoque River State Park.
Summary of specific provisions
Section 1 of the bill amends the Parks, Recreation and Historic Preservation Law to add a new § 13.32 designating certain state land as the Nissequoque River State Park.
Section 2 is the effective date.
Justification
The parcel of land described within the legislation is more commonly known as the site of the former Kings Park Psychiatric Center located in the heart of the Kings Park community in the town of Smithtown. In December of 2006, this parcel was designated as state parkland by administrative transfer between the Office of General Services, the Office of Mental Hygiene and the Department of Parks, Recreation & Historic Preservation. For most, that designation represents the full culmination of the will of the local community and its elected leadership. However, for some it remains an act that could potentially be reversed by administrative fiat contrary to the wishes of the local community. While municipal dedication of parkland is subject to legislative endorsement, the acquisition and dedication of state parkland customarily does not involve an act of the Legislature. This bill is necessary to ensure the parcel herein described remains parkland pursuant to the wishes of the community and with the full force and effect of legislative action.
