What's happening
This bill requires insurance providers to maintain a publicly available database listing health care providers' foreign language services as mandated by federal law.
Why it matters
Empowers patients with language needs. By requiring public access to detailed information on health care providers' language abilities, the bill helps patients with limited English proficiency find providers who speak their language, improving their ability to seek effective care.
Improves healthcare transparency. The mandated database ensures that customers can easily compare insurance networks based on language support, helping them make more informed choices about their insurance and providers.
Promotes compliance with federal law. By directly tying state insurance requirements to federal mandates under the Affordable Care Act, the bill reinforces and streamlines adherence to federal standards, reducing confusion or gaps in service.
Supports equitable access and health outcomes. Making language services information readily available helps address disparities in healthcare access for non-English speakers, potentially leading to better health outcomes and reduced misunderstandings or errors in treatment.

Title of bill
An act to amend the insurance law, in relation to maintaining a database of certain foreign language services as required by federal health care reform laws
Purpose
This bill will ensure that insurance customers are able to access care in their native language. Federal healthcare law has certain thresholds, which require insurers with a certain number of foreign language speaking customers to offer documents and customer service in that language. This is good, however it does not provide any requirements as to how many actual practitioners covered by the plan speak that language. This bill would require insurers on the NYS healthcare exchange to provide a database of the foreign language services offered by practitioners covered by their plan, so customers can determine the most appropriate plan for their location and language skills.
Summary of provisions
Section 3102 of the insurance law is amended by adding a new subsection (g) "Foreign language services database requirement."
Justification
This will allow the many New Yorkers who do not speak English as a first language, to more easily find a healthcare plan that offers doctors with the appropriate language skills.
Legislative history
2015-16: S.7740/A.3268 Referred to Finance.
Fiscal implications
None to the State.
Effective date
This act shall take effect on the 120th day after it shall have become law.
