AN ACT to amend the vehicle and traffic law, in relation to requiring drivers' schools to provide the department of motor vehicles with locations of instruction and requiring the commissioner to regulate where such instruction occurs
The People of the State of New York, represented in Senate and Assembly, do enact as follows:
Section 1. Section 394 of the vehicle and traffic law is amended by adding a new subdivision 7-b to read as follows:
7-b. Regulation of residential instruction. A licensee shall provide the department with information regarding the locations in which it offers supervised driving instruction on the operation of motor vehicles or motorcycles including, but not limited to, neighborhoods, public highways, and parking lots as well as such other information as the commissioner shall prescribe. The commissioner shall prescribe such reasonable rules and regulations as he or she deems necessary to prevent the oversaturation of such instruction within residential neighborhoods.
§ 2. This act shall take effect on the one hundred eightieth day after it shall have become a law; provided, however, that effective immediately, the addition, amendment and/or repeal of any rule or regulation necessary for the implementation of this act on its effective date are authorized and directed to be made and completed on or before such effective date.

Title of bill

Purpose or general idea of bill
The purpose of the bill is to prevent "over saturation" driving school instruction areas within residential neighborhoods in order to protect pedestrians and other motorists.
Summary of provisions
Section 1 of the bill amends section 394 of the vehicle and traffic law by adding a new subdivision 7-b that requires regulation of residential instruction areas. Driver's schools that are licensed by the department of motor vehicles (DMV) shall provide the department with information regarding locations in which they offer supervised driving instruction including neighborhoods, public highways and parking lots. The Commissioner of DMV will then he required to prescribe reasonable rules and regulations necessary to prevent the oversaturation of such instruction within residential neighborhoods.
Section 2 provides that this act shall take effect immediately.
Justification
Current law does not proscribe where drivers schools may provide supervised driving instruction. This has led to certain residential neighborhoods being overrun by excessive numbers of driver's schools all operating within the same residential areas because the streets are not as heavily trafficked as they may be in other more commercial areas.
Many of these residential neighborhoods are densely populated with families with children and the sidewalks and cross walks have significant pedestrian traffic. Having a large number of inexperienced drivers being given supervised driving instruction by presents significant hazards to public safety.
This legislation will simply require driver's schools to provide DMV with information on areas they use to provide supervised driving instruction and require DMV to promulgate rules in order to prevent oversaturation of driver instruction within residential communities,in order to protect public safety.
