What's happening

This bill allows the town justice of Boylston in Oswego County to live in an adjoining town within Oswego County.

Why it matters

  1. Expands the pool of eligible candidates. for the position of town justice in Boylston, potentially addressing challenges in finding qualified local residents willing or able to serve in this judicial role.

  2. Allows individuals with close community ties. , but who live in neighboring towns within Oswego County, to hold the office, which could help maintain a high standard of justice administration even if the immediate town has a small population.

  3. Sets a specific, limited exception. rather than a broad policy change—other towns still require their justices to be residents, ensuring this is a targeted response to local needs rather than a statewide shift.

  4. Could improve continuity and stability. in the local justice system by allowing experienced candidates from adjacent towns to serve, especially important in rural areas where recruitment for such positions can be difficult.

Title of bill

An act to amend the town law and the public officers law, in relation to waiving the residency requirement for the town justice in the town of Boylston, in Oswego county

Purpose

To waive the residency requirement for the town justice in the town of Boylston.

Summary of provisions

Section 1 amends Town Law at section 23 by adding a new subdivision, 31, to waive the residency requirement as it relates to the selection of town justice in the Town of Boylston, in Oswego County.

Section 2 amends the public officers law at section 2 to add a new subdivision, 66, to exempt the town of Boylston from the requirement that an individual be a resident of the political subdivision or municipal corporation of the state for which he or she shall be chosen, or within which his or her official function is required to be exercised. Further, this section requires that the individual selected to hold office of town justice in the town of Boylston reside in a town which adjoins such town and which is in the county of Oswego.

Justification

The town of Boylston, in Oswego County, is unable to fill a town justice position due to the residency requirement in town law and public officers law. As an effort to fill this position with an interested and qualified individual, the town of Boylston seeks to draw applicants from adjoining towns in Oswego County.
