What's happening
This bill increases the distance from fifteen to forty miles for vendor tracks near Native American class III gaming facilities affecting vendor fees.
Why it matters
Expanding the distance threshold from 15 to 40 miles. means more vendor tracks will now be subject to the special 41% vendor fee rate if they are near Native American class III gaming facilities, potentially affecting their profitability and operations.
This change may provide greater protection for Native American casinos. by reducing the competitive advantage of nearby vendor tracks, possibly preserving local revenue and jobs tied to tribal gaming.
Tracks that were previously outside the fee zone may now face increased financial obligations,. which could impact their business models and decisions about investment, employment, or even continuing operations.
The amendment could affect state and local tax revenues,. as the redistribution of gaming activity or changes in vendor track operations might shift where and how much revenue is generated and shared.

Title of bill
An act to amend the tax law, in relation to vendor fees at certain vendor tracks
Purpose
This bill increases vendor fees to the facilities located within forty miles of a Native American class III gaming facility.
Summary of provisions
Amends section 1612 of the tax law to increase vendor fees at certain tracks.
Justification
Western New York Racinos are a strong economic driver for local econo- mies that also provide critical revenue for county governments through- out the region. As such, it is vitally important that the state act to increase vendor fees to these facilities. These changes will allow West- ern New York Racinos the kind of economic certainty that is needed to not only retain their current workforce, but also to seriously contem- plate expansion. As New York implements changes to its gaming laws and rules and contemplates others, it is important to make sure that a level playing field exists for those gaming venues that already support the local economy. This bill aims to do exactly that.
