What's happening

This bill repeals a law related to the termination of Garden City village police department members' services.

Why it matters

  1. Repealing this section removes specific, possibly unique, protections or procedures for firing police officers in Garden City. , which could mean their employment status will now be governed by general state labor and civil service laws instead of special local rules.

  2. This change could affect how police accountability or discipline is handled in Garden City. , potentially making it either easier or harder to terminate officers, depending on the differences between the repealed provisions and broader state law.

  3. The repeal might impact ongoing or future employment disputes. , as officers losing the unique local protections may have fewer legal grounds to contest terminations or disciplinary actions.

Title of bill

An act to repeal section 19 of the special provisions for village police departments law relating to termination of services of members of the police department of the village of Garden City

Purpose

Repeal the requirement that members of the Village of Garden City police department separate from service upon attaining the age of 60.

Summary of provisions

Section one repeals § 19 of § 2 of Chapter 891 of the laws of 1972, constituting the special provisions for village police departments law.

Section two provides that this act shall take effect immediately.

Justification

Recent collective bargaining negotiations have highlighted the need to repeal this provision of law which requires officers of the Village of Garden City police department to retire at age 60. Under the current agreement parties have negotiated, there are several officers over the age of 60 that all parties would like to remain and not force into retirement. Thus this legislation repeals this provision of law relating only to the Village of Garden City police department.
