What's happening
This bill retroactively approves and authorizes the city of Rome to discontinue and substitute certain waterfront parklands, with conditions.
Why it matters
Retroactive Legalization. The bill retroactively legalizes the city of Rome’s previous action of removing parkland status from specific waterfront land, which was initially done without required state legislative approval. This protects the city from legal challenges over that procedural oversight.
Fair Market Value Requirement. Rome must dedicate at least the fair market value of the parkland it is discontinuing toward acquiring new waterfront parkland or making capital improvements to existing parks and recreational facilities, ensuring there is no net loss of public recreational value.
Federal Compliance Safeguard. If any federal funds were used for the original parkland, the city must meet all federal requirements related to parkland alienation, including approval from the Secretary of the Interior, before proceeding—minimizing risk of losing federal support or violating federal law.
Specific Land Identified. The legislation clearly defines the boundaries and size (4.34 acres) of the parkland at issue, making the impact of the bill precise and transparent for residents and stakeholders concerned about local green space.

Title of bill
An act alienating and substituting certain parklands in the city of Rome, county of Oneida
Purpose
To alienate lands currently designated as parklands in the City of Rome.
Summary of provisions
Sections 1 sets forth legislative authority to alienate parklands described in section 4
Section 2 sets forth City of Rome Council to authorize the discontinuation of waterfront parklands and other lands described in section 4.
Section 3 sets forth the City of Rome to dedicate to an amount equal to or greater than the fair market value of the waterfront parkland being alienated toward acquisition of additional waterfront parklands and/or toward capital improvements to existing parklands and recreational facilities.
Section 4 sets forth the area to be alienated.
Section 5 requires the City of Rome to follow federal requirements on the alienation and substitution of lands if the City receives funding from the Federal government for the alienated lands.
Section 6 sets forth the effective date.
Justification
The City of Rome, located in Oneida County, is seeking to alienate parklands for the purpose of allowing the Humane Society of Rome, Inc. to build a new animal shelter facility that would house the City's Animal Control Officer.
This bill would require the City of Rome to: either dedicate new parkland of equal or greater market value in exchange for the alienation, or; dedicate funding in an amount equal or greater than market value of the lands alienated to be used for capital improvements to the City's existing parkland. This requirement will ensure that City residents will continue to be enriched by parkland in addition to being served by the new animal shelter facility.
