What's happening

This bill allows Alan Gregory to include part-time fire instructor wages in his final average salary for teachers' retirement benefits.

Why it matters

  1. Sets a precedent for individual exceptions. Allowing Alan Gregory to retroactively count part-time fire instructor wages toward his teacher retirement benefits could open the door for other retirees in similar situations to seek special legislative relief, potentially impacting how exceptions to retirement rules are handled in the future.

  2. Cost is distributed across all employers in the retirement system. The bill specifies that the approximately $86,000 cost for this benefit will not be paid by Mr. Gregory or his former employers, but rather spread among all employers participating in the New York State Teachers' Retirement System, possibly affecting their future contributions.

  3. Acknowledges administrative or system errors. The legislation acknowledges that Mr. Gregory’s failure to enroll in the appropriate retirement system was not due to his own negligence, highlighting the importance of administrative oversight and the potential need for system reforms to prevent similar cases.
