What's happening

This bill requires gas and electric companies to offer customers a 100% renewable energy electricity tariff, subject to regulatory approval.

Why it matters

  1. Empowers consumers to directly choose 100% renewable electricity. this could accelerate demand for clean energy and give customers more control over their environmental impact.

  2. Creates a regulatory pathway for renewable tariffs. by requiring public review and commission approval, the bill aims to ensure that new renewable tariffs are fair, transparent, and consistent with state energy policy.

  3. Mandates ongoing adaptation. utilities can revise renewable tariffs as costs and market conditions change, which may help keep prices competitive and encourage further innovation in the renewable sector.

  4. Aligns with broader state climate and energy goals. by tying the definition of “renewable sources” to the state energy plan, the bill helps ensure that utility offerings stay current with evolving standards and targets for clean energy.

Title of bill

An act to amend the public service law, in relation to establishing the renewable energy tariff

Purpose

To provide customers of electric corporations with the option to purchase electricity provided one-hundred percent from renewable energy.

Summary of provisions

Section 1 adds a new section 66-o to the public service law, which provides that on or before September 1, 2018, each combination gas and electric corporation shall file an application with the commission to establish a tariff for the purpose of purchasing electricity provided one-hundred percent from renewable energy.

This section further provides that on or before January 1, 2018, the commission shall, after notice and opportunity for public comment, approve, modify, or reject the tariff. Within sixty days of commission, approval of a combination gas and electric corporation's tariff filed pursuant to this section, such combination gas and electric corporation shall make the tariff available to customers. The combination gas and electric corporation may at any time propose revisions to a tariff under this section based on changing costs and conditions.

Section 2 provides the effective date.

Justification

Many electricity consumers are interested in purchasing electricity produced completely by renewable energy. In fact, in the Westchester Power community choice aggregation program, several of the participating communities opted to purchase one-hundred percent renewable energy.

While some electricity customers have the option to purchase one-hundred percent renewable energy through their participation in a community aggregation program, or by receiving their energy supply from an energy services company, traditional utility customers do not currently have this option. By requiring utilities to offer a one-hundred percent renewable energy option to customers, more customers will have the abil- ity to purchase renewable energy.
