What's happening

This bill allows the Commissioner of Corrections and Community Supervision to approve retired persons for employment in the department.

Why it matters

  1. Expands hiring flexibility for the Department of Corrections and Community Supervision (DOCCS). By allowing the commissioner to approve the rehiring of retirees, the DOCCS can more easily fill critical positions with experienced personnel, especially in cases of staffing shortages or specialized needs.

  2. Potential impact on workforce composition and costs. Bringing retirees back may help address immediate staffing gaps without the longer training periods required for new hires, but it could also influence pension liabilities and wage structures within the department.

  3. Ensures oversight and accountability. The bill gives explicit authority to the commissioner, adding a layer of administrative oversight to ensure that such rehires are appropriate and necessary, not automatic or unchecked.

  4. Aligns DOCCS with other state agencies. Similar rehiring provisions already exist for positions in the judicial system; this amendment places DOCCS on comparable footing, potentially standardizing retiree employment practices across state entities.

Sponsor's memo

Title of bill

An act to amend the retirement and social security law, in relation to authorizing the commissioner of corrections and community supervision to approve a retired person's employment in a position in the department of corrections and community supervision

Purpose or general idea of bill

To allow retired correction officers to be employed and earn compensation in another position in the public service.

Summary of specific provisions

1. Authorizes the commissioner of corrections and community supervision the authority to allow retired individuals to receive compensation in the public service.

2. Effective date.

Justification

Currently, retired public employees must apply for a "211 Waiver" in order to earn more than $30,000 per year. This process, can often become burdensome. This bill would allow the department of corrections and community supervision to hire individuals without needing a "211 Waiver." Retired corrections officers have the experience to assist the department of corrections and community supervision that new employees do not. The State would benefit from having seasoned professionals contributing their knowledge and experience to better DOCCS and who would otherwise stay retired.
