What's happening

This bill repeals a law relating to the termination of Garden City village police department members.

Why it matters

  1. Removes unique job protections or procedures. Repealing section 19 eliminates special rules that previously applied to how Garden City village police officers could be terminated, potentially making their employment status subject to the same rules as other municipal employees.

  2. Shifts authority or process. The repeal may transfer decision-making power regarding police terminations from a specific provision back to general state or village law, possibly making terminations simpler for village officials or aligning Garden City with standard practices.

  3. Affects police job security and union negotiations. Without the special provision, police officers in Garden City might have less job security or fewer procedural protections, which could impact future contract negotiations, morale, and the attractiveness of police employment in the village.

Title of bill

An act to repeal section 19 of the special provisions for village police departments law relating to termination of services of members of the police department of the village of Garden City

Purpose

Repeal the requirement that members of the Village of Garden City police department separate from service upon attaining the age of 60.

Summary of provisions

Section one repeals § 19 of § 2 of Chapter 891 of the laws of 1972, constituting the special provisions for village police departments law., as added by Chapter 955 of the laws of 1973.

Section two provides that this act shall take effect immediately.

Justification

Recent collective bargaining negotiations have highlighted the need to repeal this provision of law which requires officers of the Village of Garden City police department to retire at age 60. Under the current agreement parties have negotiated, there are several officers over the age of 60 that all parties would like to remain and not force into retirement. Thus this legislation repeals this provision of law relating only to the Village of Garden City police department.
