What's happening
This bill allows deputy sheriffs certified by the NYPD after graduating from the NYPD academy to receive retirement service credit.
Why it matters
Expands retirement benefit eligibility. for deputy sheriffs who complete the NYPD academy, potentially making these positions more attractive and facilitating career mobility between law enforcement agencies.
Recognizes NYPD training as equivalent. to municipal police council certification for the purpose of retirement credit, which could streamline hiring and onboarding processes for counties seeking experienced law enforcement officers.
Minimal fiscal impact. is expected due to the limited number of deputy sheriffs affected, suggesting the bill provides targeted relief without significant new costs to taxpayers or pension funds.
May address fairness and retention issues. by ensuring deputy sheriffs with NYPD training are not disadvantaged in retirement planning compared to those certified through other channels, which could support workforce stability and morale.

satisfactory completion of the basic training program and graduation from the New York city police academy.
§ 3. Paragraph 2 of subdivision j of section 552 of the retirement and social security law, as added by chapter 542 of the laws of 2015, is amended to read as follows:

§ 4. This act shall take effect immediately.
FISCAL NOTE.--Pursuant to Legislative Law, Section 50:
This bill would allow a County to elect to provide that creditable
service on the 20 or 25 year retirement plans for sheriffs shall also
include all service performed by a deputy sheriff who has been awarded
certification by the police department of New York City for the satis-
factory completion of the basic training program and graduation for the
New York City police academy.
If this bill is enacted, this bill could provide service credit on a
20 or 25 year retirement plan, where it otherwise would not be credita-
ble. However, this bill is expected to impact very few members. The
cost of this bill would be minimal.

Title of bill
An act to amend the retirement and social security law, in relation to the certification of a deputy sheriff as a police officer
Purpose or general idea of bill
To allow for sheriff's departments to accept graduation certificates from the NYC Police Department for the purpose of computing creditable service.
Summary of provisions
Section one of this bill amends section 550 of the Retirement and Social Security Law.
Section two of this bill amends section 551 of the Retirement and Social Security Law.
Section three of this bill amends section 552 of the Retirement and Social Security Law.
Section four of this bill provides that this act shall take effect imme- diately.
Justification
Chapter 542 of the Laws of 2015 provided an additional option for coun- ties to certify "creditable service" for deputy sheriffs in their employ. Chapter 542 allowed counties that opted in to now use a deputy's status and training as a police officer "as certified by the municipal police council" in lieu of requiring 51% criminal work. Most deputy sheriffs attend police academies certified by the Municipal Police Coun- cil where upon graduation they receive a Bureau of Municipal Police Training Council Certificate ("BMPTC"). However, the NYC Police Depart- ment is a "self-issuing" agency in NYS that does not issue an MPTC certificate. Deputy Sheriffs who attended the NYC Police Academy and subsequently transferred to sheriffs departments that did not require them to attend their local police academies do not have a BMPTC certif- icate.
This bill would clean up this issue for former NYC Police Officers who have transferred to sheriffs departments around the state by accepting their graduation certificate from the NYC Police Department for the purpose of computing creditable service.
