What's happening

This bill allows the Queensbury town board to remove five specified parcels from the Glen Lake aquatic plant growth control district if they have not benefited from it.

Why it matters

  1. Property owners whose land has not benefited from the aquatic plant growth control district could see their tax or fee burden reduced. if their parcels are removed, which may be especially relevant for those who have paid into the district without receiving services.

  2. The bill creates a new, specific process for removing parcels from the district. , allowing the town board to act on its own initiative (not just in response to petitions) but still requiring a public hearing and making the board’s decision subject to a permissive referendum—so local residents can challenge the removal if enough object.

  3. By clarifying how and when parcels may be excluded from the district, the bill could set a precedent. for handling similar situations in other special districts, potentially leading to more tailored district boundaries and fairer cost distribution.

  4. Listing the specific parcels to be removed ensures transparency and accountability. , making it clear which landowners are affected and providing a public record of the legislative intent and action.

Title of bill

An act to amend the town law, in relation to authorizing the town board of the town of Queensbury, in the county of Warren, to diminish the area of the Glen Lake aquatic plant growth control district

Purpose

Authorizes the Queensbury town board to diminish the area of the Glen Lake aquatic plant growth control district.

Summary of provisions

Section 1 amends section 202-c of the town law to add a new subdivision 11 to authorize the town of Queensbury to, upon its own motion and with- out a petition, but after a public hearing, diminish the Glen Lake aquatic plant growth control district by deleting the five parcels described in the legislation.

Section 2 contains the effective date.

Justification

The Glen Lake aquatic plant growth control district is a special district located in the town of Queensbury, in the County of Warren. This special district was established pursuant to New York State Town Law for the benefit of the property owners who have access to or are bordering Glen Lake. This special taxing district was described by using tax map parcel identification numbers. However, there are parcels in the Glen Lake aquatic plant growth control district that do not benefit from the improved water quality resulting from the management of invasive species.

The Town Board does not have the authority pursuant to Town Law section 202-c to remove the parcels on its own motion. Consequently, the town has requested that this special legislation be adopted so that the parcels of real property identified as not being benefitted by the Glen Lake aquatic plant growth control district can be removed from the special district.
