AN ACT to amend the executive law, in relation to authorizing the division of minority and women's business development to accept the DD Form 214 issued by the United States department of defense upon retirement, separation, or discharge from active duty in the armed forces of the United States as proof of the race or ethnicity and certain personal information of an applicant for purposes of certification of the applicant's business as a minority-owned business
The People of the State of New York, represented in Senate and Assembly, do enact as follows:
Section 1. Section 314 of the executive law is amended by adding a new subdivision 2-b to read as follows:
2-b. The director shall establish a procedure enabling an applicant who was a military service member to prove his or her race or ethnicity, date of birth, place of birth and verification of address for purposes of certification of the applicant's business as a minority-owned business by submission of the DD Form 214 issued to the applicant by the United States department of defense upon such applicant's retirement, separation, or discharge from active duty in the armed forces of the United States, provided the DD Form 214 contains such information, in lieu of requiring the applicant to otherwise prove his or her race or ethnicity. The director shall promulgate rules and regulations to set forth criteria for the acceptance of the DD Form 214 by the office.
§ 2. This act shall take effect on the ninetieth day after it shall have become a law; provided, however, that the amendments to section 314 of the executive law made by section one of this act shall not affect the expiration of such section and shall be deemed expired therewith.

Purpose
The purpose of this bill is to create a process for minority veterans to become recognized as a certified minority and women-owned business enterprise (MWBE).
Summary of provisions
Section 1 of the bill amends section 314 of the executive law by includ- ing a procedure which allows past military service members to confirm their race or ethnicity, date of birth and verification of address in the interest of being recognized as a certified minority business by the submission of the DD Form 214. The director shall promulgate rules and regulations to set forth criteria for the acceptance of the DD Form 214.
Section 2 is the effective date.
Justification
This bill intends to enable veterans to utilize their DD214 form for the purpose of providing municipal corporations and State agencies, a form of identification for enrollment in MWBE programs. In certain cases, veteran minority-owned business enterprises have been denied access to enrollment as their classified race or ethnicity even with proof present on DD Form 214, a federal document, which was not listed as valid source of verification. Enactment of this bill would alleviate certain verifi- cation burden veterans may have when looking to qualify for MWBE programs.
