What's happening
The bill allows certain Office of Mental Health employees a one-time, irrevocable choice to switch their retirement plan within 60 days.
Why it matters
Provides a rare "second chance" for eligible Office of Mental Health employees. those in specified Security Hospital Treatment Assistant titles—to reconsider their retirement plan, which could be significant for employees whose personal or career circumstances have changed since their initial election.
The irrevocable nature of the switch means employees must carefully weigh long-term impacts. on their pension, healthcare, and retirement security, as they will permanently forfeit the benefits of their original plan in favor of the new one.
Could impact retention and job satisfaction. among affected staff by allowing them to align their retirement plan with their current needs or expectations, potentially reducing regret or dissatisfaction stemming from a previous, possibly less informed, choice.
Carries a notable fiscal impact for the state. , including an immediate one-time cost of nearly $10 million and an increased annual contribution of $860,000, reflecting the financial implications of allowing plan switches and possible shifts in benefit payouts.

LBD15003-03-8
S. 8012 2
Currently, security hospital treatment assistants (SHTAs) employed by
the office of mental health must elect within one year of being employed
in such a title to become covered under either an age-55 based plan or a
25-year service based plan. This bill will permit members a one-time
election to switch from his/her current plan in favor of the other plan.
The election to switch plans is irrevocable, and the member gives up all
rights and privileges of his/her current plan. The bill has a sunset
provision of 60 days.
If this bill is enacted, the estimated increase in the annual contrib-
utions of the state of New York for the fiscal year ending March 31,
2019 would be approximately $860,000.
In addition to the annual contributions discussed above, there will be
an immediate past service cost of $9.97 million, which will be borne by
the state of New York as a one-time payment. This estimate is based on
the assumption that payment will be made on March 1, 2019.
These estimated costs are based on 630 members having an annual salary
for the fiscal year ending March 31, 2017 of approximately $55 million.

Title of bill
An act to amend the retirement and social security law, in relation to retirement benefits for certain employees; and providing for the repeal of such provisions upon the expiration thereof
Purpose or general idea of bill
This legislation would allow a member employed at OMH with the title of security hospital treatment assistant, senior security hospital treat- ment assistant, security hospital treatment assistant Spanish language, security hospital senior treatment assistant Spanish language, security hospital senior treatment assistant Spanish language, security hospital treatment assistant supervisor, or security hospital treatment assistant chief to file an election to change their retirement election during a prescribed period of time.
Summary of specific provisions
Section 1 amends Subdivision c of section 700 of the retirement and social security law to allow for the provisions of this change.
Section 2 This legislation would allow a member employed at OMH with the title of security hospital treatment assistant, senior security hospital treatment assistant, security hospital treatment assistant Spanish language, security hospital senior treatment assistant Spanish language, security hospital senior treatment assistant Spanish language, security hospital treatment assistant supervisor, or security hospital treatment assistant chief to file an election to change their retirement election during a prescribed period of time.
Section 3 is the effective date.
Justification
Currently SHTAs employed by OMH have one year to elect coverage under an age 55 based plan or a 25 year plan. This legislation will create a 60 day window for them to change their election. It has come to attention that many of the individuals employed as SHTAs are enrolled in the incorrect plan. You may have individuals who already have Civil Service credit and are older accidentally enrolled in a 25 year plan where they have no intent or ability to serve out, or younger individuals who see this as their career enrolled in the age 55 plan where they would easily have accumulated 25 years of service before then. This legislation opens a very short window for these individuals to reassess and address any issues.
