What's happening
This bill extends the Department of Environmental Conservation's authority to manage striped bass in New York until December 31, 2021.
Why it matters
Ensures continuity in striped bass management. By extending the Department of Environmental Conservation’s (DEC) authority, the bill allows New York to continue regulating striped bass fishing—helping to protect an important species for both ecosystems and recreational/commercial fisheries.
Keeps state regulations adaptable to changing science and conditions. The DEC can adjust regulations such as size and catch limits, seasons, and gear restrictions as needed, allowing for more responsive management based on up-to-date data and fish population trends.
Maintains compliance with broader regional and federal plans. The extension ensures New York remains aligned with the Atlantic States Marine Fisheries Commission and federal management plans, which is crucial for cooperative management of a migratory species and for avoiding potential penalties or fishery closures.

Title of bill
An act to amend the environmental conservation law, in relation to extending the authority of the department of environmental conservation to manage striped bass
Purpose of the bill
The purpose of this bill is to amend the Fish and Wildlife Law to allow the Department of Environmental Conservation (DEC) to extend DEC's authority to manage striped bass.
Summary of provisions
Section 1 of this bill would amend Environmental Conservation Law (ECL) § 1 1-0303(3) to extend, until December 31, 2021, DEC's authority to fix by regulation measures for the management of striped bass.
Section 2 of this bill provides that the bill shall take effect imme- diately.
Justification
DEC's regulatory authority for striped bass is necessary in order to preserve the current regulatory program. Failure to extend the existing regulatory authority by December 31, 2018 will result in the loss of regulatory protection for striped bass.
Continued regulatory authority is critical for New York to maintain compliance with the FMP for Atlantic Striped Bass. This bill would extend DEC's regulatory authority for an additional three years, and ensure DEC continues to have this mechanism to react rapidly to any changes to the FMP in a timely fashion.
Prior legislative history
DEC's regulatory authority to manage striped bass was last extended by Chapter 193 of the Laws of 2015.
Budget implications
None.
Local impact
This bill would have no impact on local governments.
Effective date
This act shall take effect immediately.
