What's happening
This bill expands the missing and exploited children clearinghouse fund to also support missing vulnerable adults in New York.
Why it matters
Broadens the purpose of the fund to address a wider population. By including "missing vulnerable adults" alongside children, the fund can now support awareness, search, and prevention efforts for adults who may be at risk due to disabilities, age, or cognitive impairments.
Enables public donations to support vulnerable adults. New Yorkers can now direct part of their state income tax refund to a fund that not only helps missing and exploited children but also missing vulnerable adults, potentially increasing resources for both groups.
Updates administrative structure and oversight. The bill clarifies and expands the authority of the Division of Criminal Justice Services to use the fund for activities aiding in the prevention, search, and recovery for both missing children and vulnerable adults, ensuring more coordinated and efficient use of resources.

Title of bill
An act to amend the tax law and the state finance law, in relation to the missing and exploited children clearinghouse fund
Purpose of the bill
To amend the Tax Law and State Finance Law to authorize the use of monies from the Missing and Exploited Children Clearinghouse Fund tax check-off for all missing persons activities.
Summary of provisions
Section one of the bill amends Tax Law § 628 to allow monies from contributions to the Missing and Exploited Children Clearinghouse Fund tax check-off to be used for missing vulnerable adult purposes.
Section two of the bill amends State Finance Law § 92-w to authorize monies from the Missing and Exploited Children Clearinghouse Fund to be used for missing vulnerable adult purposes.
Section three of the bill provides for an immediate effective date.
Justification
In 2011, the Missing and Vulnerable Adult Clearinghouse was established. The Division of Criminal Justice Services has four staff members funded exclusively from the Missing and Exploited Children Clearinghouse Fund, who, in addition to performing their missing children duties, perform duties related to missing vulnerable adults. However, duties related to missing vulnerable adults fall outside of the allowed purposes of the Missing and Exploited Children Clearinghouse funding.
Pursuant to current law, monies from the Missing and Exploited Children Clearinghouse Fund are specifically authorized for activities and purposes that aid in the prevention of the exploitation of children or in the recovery of missing and exploited children. The law is silent with regard to missing vulnerable adults.
