What's happening
This bill bans wastewater and solid waste facilities in New York from accepting or disposing of high volume hydraulic fracturing waste.
Why it matters
Protects public health and local environments. by preventing potentially hazardous byproducts of fracking—such as flowback water and brine—from entering New York’s wastewater and solid waste facilities, reducing risks of water and soil contamination.
Closes regulatory loopholes. that previously allowed fracking waste from being transported into New York from other states, addressing concerns that the state could become a dumping ground even though fracking is banned in-state.
Signals a strong policy stance. against the broader environmental and public health impacts of hydraulic fracturing, reinforcing New York’s leadership in restricting fossil fuel-related pollution.
Pushes for clear regulatory action. by requiring the Department of Environmental Conservation to create and enforce new specific rules, ensuring compliance and providing a legal basis for rejecting these wastes at treatment facilities.

Who cares
Wastewater treatment facility operators
The bill would require regulations barring high-volume hydraulic fracturing waste, including flowback water and production water or brine, from entering their facilities in New York.
Solid waste management facility operators
The bill would require regulations prohibiting disposal of high-volume hydraulic fracturing waste at their facilities.
Oil and natural gas extraction companies
The proposed prohibitions would rule out New York wastewater treatment and solid waste management facilities as disposal options for their high-volume hydraulic fracturing waste.
New York State Department of Environmental Conservation
The bill would require the department to adopt regulations implementing both prohibitions.
