What's happening

This bill requires individuals to undergo and pass a mental health evaluation before purchasing any firearm, rifle, or shotgun in New York.

Why it matters

  1. Introduces a new mandatory step in gun purchasing. By requiring a mental health evaluation before the sale of any firearm, rifle, or shotgun, the bill adds a significant screening process that goes beyond criminal background checks and could potentially identify at-risk individuals who might otherwise pass current checks.

  2. Empowers mental health professionals and state oversight. The law directs the Office of Mental Health to set up the evaluation system, including who can conduct these evaluations and how they are standardized, potentially creating a new area of responsibility for mental health practitioners and state agencies.

  3. Creates a legal avenue for appeals. If someone is denied approval to purchase a firearm based on the mental health evaluation, they can challenge the decision through a formal legal process (Article 78 proceeding), ensuring both oversight and due process.

  4. Imposes new criminal liability. Selling or buying a firearm without the required mental health evaluation would become a specific crime, adding another layer of legal accountability for both sellers and purchasers and potentially deterring illegal transactions.
