What's happening

This bill establishes that elementary or secondary school students cannot legally consent to sexual conduct with school employees.

Why it matters

  1. Closes a legal loophole by making it explicitly illegal for school employees or volunteers to engage in sexual conduct with students, regardless of claimed “consent,” if the employee is at least 18 and more than four years older than the student.

  2. Applies broadly to anyone working or volunteering in a school, not just teachers, increasing accountability for a wider range of adults who interact with students.

  3. Strengthens protections for elementary and secondary school students by recognizing the inherent power imbalance between students and school staff, aligning the law with community expectations of student safety.

  4. Establishes clear legal standards for prosecution, making it easier for authorities to take action against school employees who exploit their position, potentially deterring predatory behavior in educational settings.
