What's happening

This bill classifies community colleges as state agencies and their trustees as state officers or employees for ethics law purposes.

Why it matters

  1. Expanding ethics oversight. By classifying community colleges as state agencies and their trustees as state officers/employees, the bill extends state ethics laws (such as conflict-of-interest rules and financial disclosure requirements) to these officials, increasing transparency and accountability.

  2. Closing existing loopholes. Previously, community college trustees may not have been subject to the same ethics standards as other state officials. This change addresses possible gaps where trustees might have avoided oversight that applies to other public officers.

  3. Uniform standards across public higher education. Treating community college trustees like other state university officials standardizes expectations and enforcement of ethical conduct, which could help build public trust and ensure consistent governance practices across New York's higher education system.

Who cares

  • Community college trustees

The bill would classify them as state officers or employees under Public Officers Law § 73 regardless of whether they receive compensation, subjecting them to its rules on business and professional activities.

  • Community college administrators

The bill would classify community colleges as state agencies for purposes of Public Officers Law § 73.

  • Independent institutions operating statutory or contract colleges

The bill would replace language excluding these institutions from the definition of state agency under Public Officers Law § 73 with language including them.
