What's happening

This bill sets new guidelines for disqualifying stand-by contractors for state contracts based on performance and integrity factors.

Why it matters

  1. Expands the grounds for disqualifying stand-by contractors. by emphasizing not just legal compliance, but also past performance, price reasonableness, and contractor integrity—potentially raising the bar for eligibility to work on state contracts.

  2. Incorporates consideration of criminal convictions. only as permitted under existing fair employment laws (Article 23-A of the Correction Law), which means contractors with convictions are given a fair assessment rather than automatic exclusion, balancing public protection with rehabilitation opportunities.

  3. Aims to promote higher accountability and quality. in state contracting by explicitly including negligence, malfeasance, and prior contract performance as factors for disqualification, potentially reducing risks of poor project outcomes or misuse of public funds.
