What's happening

The bill prohibits landlords from charging surcharges for tenant-installed appliances if the tenant pays for their own electricity.

Why it matters

  1. Protects tenants from extra costs. By prohibiting landlords from charging surcharges for tenant-installed appliances when tenants pay for their own electricity, the bill ensures tenants aren’t double-billed for their energy use.

  2. Supports affordability and tenant choice. This measure can help keep housing more affordable and allows tenants greater flexibility in choosing and installing appliances without fear of additional fees.

  3. Targets rent-controlled units during housing emergencies. The bill specifically applies to rent-controlled apartments and remains in effect only while the city’s housing emergency is recognized, emphasizing its role in protecting vulnerable tenants during periods of housing instability.

Who cares

  • New York City rent-controlled tenants

Tenants who pay for electric utility service would be protected from surcharges for installing or using tenant-installed appliances.

  • Owners of rent-controlled apartments

Landlords would be prohibited from imposing those appliance surcharges where tenants pay for electricity.

  • Rent-controlled tenant advocates

The bill would establish an appliance-surcharge protection that lasts as long as the public emergency requiring rent and eviction controls continues.
