What's happening
This bill requires all counties, except those entirely within a city, to follow referral rules for proposed planning and zoning actions.
Why it matters
Expands oversight. By making county referral requirements universal (except for counties entirely within a city), this bill increases the number of local planning and zoning decisions that must be reviewed at the county level, potentially leading to more consistent regional planning.
Limits local autonomy. Towns and villages in affected counties will have less independent authority over planning and zoning, as more of their proposals will need county review, which could slow down approval processes but also ensure broader coordination.
Preserves city-based counties’ autonomy. Counties that are completely within a city (like New York County/Manhattan) are exempt, maintaining their current local planning processes and acknowledging their unique governance structures.
Applies immediately to pending proposals. Any planning or zoning proposals not finalized by the law’s effective date will fall under these new rules, which could affect current projects and require localities to revisit their referral procedures.
