What's happening
This bill requires the New York Public Service Commission to adjust zero emissions credit prices based on proportional benefits in each energy zone.
Why it matters
Directs state support for nuclear plants to reflect local benefits. The bill ensures that zero emissions credit (ZEC) pricing for nuclear facilities is directly tied to economic and environmental advantages realized by each energy zone, rather than applying a uniform statewide credit price.
Considers multiple forms of local benefit. It defines “proportional benefits” broadly, including reduced fossil fuel emissions, local tax contributions, and employment opportunities tied to nuclear plant operations—meaning credit prices could rise in regions where these impacts are greatest.
Impacts local economies and electricity costs. By making ZEC prices responsive to local benefits, the bill could affect the financial stability of nuclear plants in different regions, potentially influencing local tax bases, job markets, and even electricity rates depending on the zone’s reliance on nuclear energy.
Imposes a tight timeline for regulatory action. The Public Service Commission must implement these pricing adjustments by August 1, 2019, signaling urgency and potentially rapid changes for affected energy zones and stakeholders.

The People of the State of New York, represented in Senate and Assembly, do enact as follows:
