What's happening

This bill allows New York government agencies to sell, lease, or otherwise dispose of electronic data, setting rules and fees for access.

Why it matters

  1. Defines key terms like “database,” “data file,” and “electronic record,”. clarifying what types of digital information fall under the law and thus setting clear boundaries for what agencies can sell, lease, or otherwise dispose of.

  2. Allows agencies to set their own rules and prices for public access to electronic data,. potentially enabling government bodies to generate revenue from the information they maintain, but also raising questions about affordability and equitable access to public data.

  3. Specifies that fees for electronic records may include staff time, computer use, and storage media costs,. but caps those fees so they do not exceed the comparable cost of providing paper photocopies, plus storage—this could affect how much agencies can charge and may influence public use.

  4. Requires that any money earned from these electronic data transactions goes to the general fund of the agency’s parent public corporation,. meaning the revenue could be used for general government purposes rather than being earmarked for specific projects or transparency initiatives.
