What's happening
This bill allows possession of large capacity ammunition feeding devices manufactured before September 13, 1994, in New York.
Why it matters
Restores an exemption. for the possession of certain high-capacity magazines, specifically those made before September 13, 1994, which were previously legal under federal law but banned under New York's SAFE Act—potentially impacting collectors and gun owners who own older magazines.
Retroactive application. means anyone possessing these devices since January 15, 2014 (when the SAFE Act provisions took effect) could benefit, potentially protecting individuals from prosecution for possession that occurred during this period.
Narrows the scope of New York’s magazine ban. by distinguishing between “pre-ban” and post-ban magazines, which could complicate law enforcement efforts and may lead to increased legal scrutiny over how to determine a magazine’s manufacture date.
