What's happening

This bill requires health insurers in New York to offer out-of-network coverage options both inside and outside the health benefit exchange.

Why it matters

  1. Expands consumer choice and flexibility. by ensuring that all health insurers must offer at least one plan with out-of-network coverage, giving individuals more options if their preferred providers are not in-network.

  2. Addresses network adequacy concerns. , helping patients who live in areas with limited in-network provider access, specialists, or facilities by making sure out-of-network options are available both on and off the state health exchange.

  3. May impact insurance premiums and plan design. , as requiring insurers to offer out-of-network coverage could lead to higher costs for those plans, potentially affecting affordability and the range of plan types available to consumers.

  4. Standardizes availability across the entire market. , meaning that whether someone purchases insurance through the state-run exchange or directly from an insurer, they will have access to plans that include out-of-network coverage, reducing potential gaps in consumer protections.
