What's happening
This bill prohibits advertisements for electronic cigarettes, liquid nicotine, and hookah tobacco within 500 feet of schools or parks in New York.
Why it matters
Targets youth exposure. By limiting advertisements near schools and parks, the bill aims to reduce the visibility and appeal of vaping and hookah products to children and teenagers, who are especially vulnerable to marketing tactics.
Defines covered products clearly. The bill specifically defines “electronic cigarettes,” “liquid nicotine,” and “hookah tobacco,” ensuring that a broad range of related products cannot exploit loopholes or ambiguous language to continue advertising near prohibited areas.
Establishes clear enforcement and penalties. Businesses that violate this advertising restriction face significant fines, with increased penalties for repeated offenses, which could deter retailers from skirting the law.
Includes exceptions for certain indoor ads. The law allows advertisements inside buildings within the restricted area only if they are not visible from outside, acknowledging business needs while still protecting public spaces from targeted marketing.
