What's happening

This bill expands the definition of "explosives" to include kits of components sold with instructions to create detonating or combustible devices.

Why it matters

  1. Broadens legal responsibility. By including kits of components sold with instructions for assembly into the definition of "explosives," the bill holds both sellers and buyers of such kits to the same legal standards as those dealing with traditional explosives, potentially increasing liability and enforcement actions.

  2. Targets DIY explosive device kits. The change aims to address the growing issue of individuals acquiring parts and instructions separately to make dangerous devices, closing a loophole that allowed for legal sale of components that, when combined, create explosives.

  3. Impacts commercial and online marketplaces. Sellers—especially those operating online—will need to review their product offerings and marketing to ensure that component kits with instructions for creating explosive or incendiary devices are not inadvertently violating state law.

  4. Enhances public safety measures. The amendment is designed to preemptively reduce the risk of homemade explosive devices by making it harder to legally obtain the necessary components together with assembly instructions, potentially deterring criminal or reckless misuse.
