What's happening

This bill authorizes Buffalo to implement a five-year school zone speed camera demonstration program, imposing fines on vehicle owners for speeding violations detected by photo devices.

Why it matters

  1. Establishes New Enforcement Tools & Zones. The bill allows Buffalo to set up automated speed cameras in up to 20 school speed zones, targeting speeding violations specifically during school hours and student activities. This means drivers may be ticketed even if no police officer is present, changing how speeding is enforced and possibly increasing the number of violations detected.

  2. Owner Liability & Due Process. Vehicle owners (not necessarily the driver) are held financially liable for speeding violations caught by these cameras. The process includes mailed notices with photographic evidence, but owners have opportunities to contest the fine and defenses such as the vehicle being stolen or operated without consent. This shifts accountability and could impact car owners who lend their vehicles to others.

  3. Privacy, Data Use, and Oversight. The legislation contains strict rules about the use, retention, and disclosure of photographic evidence, limiting it to enforcement purposes and prohibiting general public access. Images must avoid identifying drivers or passengers when possible, and are subject to limited release under court order. This addresses concerns about surveillance and misuse of personal data.

  4. Program Evaluation and Public Reporting. The bill requires detailed public reporting on the program’s effectiveness, including data on crashes, injuries, revenue, and adjudication outcomes in the affected zones. This transparency is designed to ensure the program is meeting its safety goals and not merely acting as a revenue generator, and may influence future decisions about making the program permanent or expanding it.
