What's happening

This bill requires written notice and opportunity to respond for all ex parte communications in public hearings, removing certain exemptions for public utilities.

Why it matters

  1. Increases transparency and fairness. by requiring all parties in public hearings (including those involving utilities) to receive written notice of any off-the-record communications (ex parte), ensuring everyone is aware of all interactions that could influence a decision.

  2. Closes loopholes for utility companies. by removing previous exemptions that allowed certain ex parte communications in cases involving public utilities, meaning these powerful entities are now subject to the same procedural fairness as other parties.

  3. Strengthens public oversight and trust. in regulatory and administrative hearings by guaranteeing that parties can respond to ex parte contacts, reducing the risk of undisclosed influence on decisions that affect rates, services, and public interests.

  4. Aligns administrative procedures. with broader principles of due process, making it harder for any party—including large corporations or state agencies—to gain an unfair advantage through private communications during official proceedings.
