What's happening

This bill requires electronic cigarette companies in New York to annually disclose their online advertising expenditures and details to the state.

Why it matters

  1. Increases transparency about how and where e-cigarette companies are advertising online. , providing the public, regulators, and researchers with more information about the industry's marketing practices, especially regarding digital platforms.

  2. Enables the state health department to monitor and potentially address advertising targeted at or seen by children. , as the annual report to the governor and legislature may include recommendations to limit youth exposure to these ads.

  3. May lead to stricter regulations on e-cigarette marketing in the future. , since the bill directs the department to propose rules and regulations based on the data collected, possibly resulting in new restrictions or best practices for online advertising.

  4. Could place administrative and reporting burdens on e-cigarette companies. , requiring them to track and disclose detailed data on their online ad spending, which may increase compliance costs and affect how they approach digital marketing in New York.

Title of bill

An act to amend the public health law, in relation to adopting require- ments that electronic cigarette companies disclose online advertisements

Purpose

The purpose of this legislation is to require the disclosure of internet advertising of electronic cigarettes.

Summary of provisions

Section one amends section 1399-KK of the public health law by adding a new subsection (3) to require the disclosure of all expenditures related to the online advertising of electronic cigarettes.

Section two is the effective date.

Justification

According to the CDC, more than 18 million young people were exposed to e-cigarette advertising online in 2014. Advertising by e-cigarette companies has increased dramatically in recent years and this advertis- ing works. The number of high school students who vape doubled between 2014 and 2016.

Currently, companies are not required to disclose what they spend on e-cigarette internet advertising and where that money goes. This bill would require such disclosure. New Yorkers deserve to know how and where these companies are advertising these unsafe products and how likely their children are to see such ads.
